MPUSD Shares New State-Required “Know Your Educational Rights” Information

In accordance with new California law, Monterey Peninsula Unified School District has posted “Know Your Educational Rights” information at all school sites, administrative buildings, and on district and school websites as of January 1, 2026.

These postings are required under Education Code 234.7 and are designed to ensure families clearly understand their rights and protections within California public schools.

The information highlights that:

  • All students have the right to a free public education, regardless of immigration or citizenship status

  • Families may use a variety of documents to verify age and residency for enrollment

  • Schools do not collect or require immigration status information

  • School staff are prohibited from sharing student or family information with immigration enforcement without a valid judicial warrant, subpoena, or court order

  • Immigration enforcement officers may not enter non-public school areas without proper legal authorization

In addition, as part of the Family Preparedness Plan Act (AB 495), the Caregiver Authorization Affidavit has been updated effective January 1, 2026. This form allows a qualified caregiver to enroll a student and make school-related decisions when a parent or guardian is unavailable and is often included within district enrollment and residency policies.
